This Privacy Policy explains how Smith Consulting & Design, LLC, doing business as The Web Smithy (“we,” “us,” or “our”), collects, uses, and shares information when you visit this website or use our website design, hosting, domain, webmaster, and Google Business Profile services. By using this website, you agree to the practices described here.
1. Information we collect
Information you give us
- Contact and inquiry forms: your name, email address, phone number, and the message you send.
- Proposal questionnaire: your business name, the services you are interested in, domain ideas, budget estimates, example websites, project details, and any file you choose to upload.
- Clients: billing contact details, service and account information, and the content, logins, and files you provide so we can build or manage your website.
- Support requests: details you include when you report an issue or open a ticket.
Information collected automatically
- Server logs: like most websites, our hosting server records your IP address, browser type, pages requested, referring page, and the date and time of each visit. We use these logs for security and troubleshooting.
- Cookies: see Section 5.
We do not collect payment card numbers on this website. Payments are handled by our payment processors (see Section 4).
2. How we use your information
- To answer your questions and prepare quotes and proposals.
- To provide, bill for, and support the services you buy from us.
- To register and renew domain names and set up hosting accounts you order.
- To send service messages such as invoices, renewal reminders, and maintenance notices.
- To protect this website and our clients’ websites from spam, fraud, and abuse.
- To meet legal, tax, and accounting obligations.
We will not add you to a marketing email list unless you ask to be added. If you do receive marketing email from us, every message will include a way to unsubscribe.
3. We do not sell your information
We do not sell, rent, or trade your personal information, and we do not share it for targeted advertising.
4. Who we share information with
We share information only with service providers who help us run our business, and only as much as they need to do their job:
- Hosting and infrastructure: WPMU DEV (Incsub, LLC), which hosts this website and our client hosting accounts and provides our client billing and reseller tools.
- Payment processing: Stripe, Inc. and WPMU DEV billing. They receive the payment details you enter on their secure pages and handle them under their own privacy policies.
- Domain registration: when you register a domain through us, the domain registrar and registry receive the registrant contact information that ICANN rules require. Some of this information may appear in public domain registration (WHOIS/RDAP) records unless privacy protection is available and applied.
- Email: the provider that delivers and stores our business email.
- Legal reasons: when required by law, subpoena, or court order, or to protect our rights, our clients, or the public.
- Business transfer: if our business is sold or merged, customer information may transfer to the new owner under this policy.
5. Cookies and third-party content
This website does not use advertising cookies or analytics tracking. A few cookies may be set for site security, for form submissions, or when you are logged in to the site.
Some pages include content from other companies, which may set their own cookies or collect your IP address when the page loads:
- Elfsight: a widget that displays reviews. See Elfsight’s Privacy Policy.
You can block or delete cookies in your browser settings. Most of this website works without them.
Do Not Track: because we do not track visitors across other websites, we do not change our practices in response to browser “Do Not Track” signals.
6. Data on our clients’ websites
When we build, host, or manage a website for a client, that website may collect information from its own visitors. The client owns that website and is responsible for its own privacy policy and practices. We access and process that information only to provide our services to the client, and we follow the client’s instructions.
7. How long we keep information
- Inquiries and proposal requests that do not become projects: up to 2 years, then deleted.
- Client records, contracts, and invoices: for as long as you are a client, plus up to 7 years for tax and legal purposes.
- Server logs: kept for a limited period by our hosting provider, then deleted automatically.
8. How we protect information
This website uses an encrypted (HTTPS) connection. We limit access to personal information, keep software up to date, and use reputable providers. No method of sending or storing data is completely secure, so we cannot guarantee absolute security. If we learn of a breach that affects your personal information, we will notify you as required by law, including Florida’s breach-notification law (Fla. Stat. § 501.171).
9. Your choices and rights
You can ask us to:
- Tell you what personal information we hold about you.
- Correct information that is wrong.
- Delete your information, unless we must keep it to complete a service, for billing, or to meet a legal obligation.
- Stop sending you marketing messages.

California residents: this policy is provided under the California Online Privacy Protection Act. Because we do not share personal information with third parties for their own direct marketing, California’s “Shine the Light” law (Cal. Civ. Code § 1798.83) requests do not apply, but you may still contact us with any privacy question.
10. Children
This website and our services are for businesses and adults. We do not knowingly collect personal information from children under 13. If you believe a child has sent us information, contact us and we will delete it.
11. Links to other websites
This website links to other websites, including our social media pages and the websites in our portfolio. We are not responsible for their privacy practices, so please read their policies.
12. Changes to this policy
We may update this policy from time to time. We will post the new version on this page and change the effective date above. If we make a significant change, we will tell current clients by email.
